
“It’s not surprising that a federal judge out of Hawaii found in favor of Chemical Abortion Pills in a case brought by the ACLU, but this kind of activism must be appealed,” said Students for Life’s Kristan Hawkins. “The FDA allows Chemical Abortion Pills to be distributed in conditions never tested for, unlawfully given the constraints of the Comstock Law, and without ever looking into potential environmental harms, as required. Safe, Legal, and Rare doesn’t mean what it used to, and this is a mistake that the Trump Administration needs to address in court.”
WASHINGTON D.C. (10-31-2025) – Students for Life of America (SFLA) & Students for Life Action (SFLAction) President Kristan Hawkins called news of an American Civil Liberties Union (ACLU) win in federal court “more evidence that all the wrong people are handling the review of Chemical Abortion Pills, and that’s why we’ve called for a real, thorough review managed by those who have not rubberstamped the process so far.”
Hawkins continued, “U.S. District Judge Jill Otake’s ruling would be laughable if the stakes were not life and death. She said that ‘by failing to provide a reasoned explanation for its restrictive treatment’ of Chemical Abortion Pills, then apparently no restrictions are needed. It’s hard to know who may be at fault here, the previous attorneys in the case who did not present well or the court, in ignoring evidence of serious problems with the deadly drugs. It’s important that the Trump Administrations Department of Justice (DOJ) appeal this case because for once, the ACLU is right, this case has been used to attack common-sense safety standards for Chemical Abortion Pills.”
As Hawkins wrote in National Review, “safe” is a word treated loosely by the abortion lobby as it “all depends on how women feel about infection, surgery, infertility, depression, horrifying pain, and even death.”
“This judge also ignored the environmental failures of this process as well,” said Hawkins. “What is not addressed at all in this decision is the fact that the FDA did not do required environmental testing. Right now, FDA policy ignores abortion water pollution – the dumping of more than 50 tons of chemically tainted blood and placenta tissue, along with precious human remains into America’s waterways. That is an issue that needs to be raised on appeal.”
