
U.S. Supreme Court Hands Down Pro-Life & Commonsense Decision in 6 to 3 Decision in Medina v. Planned Parenthood South Atlantic
“Taxpayers should not be forced to support abortion vendors. When it comes to our scarce healthcare resources, the Pro-Life Generation embraces a ‘pro-choice’ model, meaning we ‘choose’ to tell Planned Parenthood to go fund itself,” said Students for Life of America’s Kristan Hawkins. “With this decision in hand, we ask the U.S. Senate to continue this effort in the budget reconciliation process and to put healthcare dollars in the hands of people who do no harm to the least of these.”

WASHINGTON, D.C. (06-26-2025) – In an 6 to 3 decision, the U.S. Supreme Court handed South Carolina a victory in the Medina v. Planned Parenthood South Atlantic,benefiting preborn children and taxpayers in the state, with implications for our federal government. The affirmation of the state government’s right to decide which businesses to fund through Medicaid means Planned Parenthood can be kicked out of the program in favor of real, full-service medical care. Students for Life of America (SFLA) President Kristan Hawkins celebrated the win as “a first step in ending Planned Parenthood’s abuse of healthcare dollars. Planned Parenthood claims it’s ‘qualified’ to get our money just because they crossed their t’s and dotted their i’s. However, with this decision in hand, it’s time to take the next step and cut them from federal coffers on the way to debarring them.”
“This decision is yet another tool in our arsenal to address Planned Parenthood’s poor track record of shoddy “healthcare services” for women and legacy of ending millions of babies’ lives.And no matter what we are hearing today about the Parliamentarian and the budget, we will continue to talk with Congress, urgingour legislators to redirect healthcare spending to those who care whether all patients live or die,” said Hawkins. “If states can tell Planned Parenthood to go fund themselves, then the federal government can as well.”
Kerr v. Planned Parenthood South Atlantic (also known as Medina v. Planned Parenthood South Atlantic) addressed whether theMedicaid Act’s any-qualified provider provision unambiguouslygrants a private right to a Medicaid beneficiary to choose a specific provider. It also examined the scope of a beneficiary’s alleged right to select a provider that a state has deemed disqualified.
As SFLA Vice President of Media & Policy Kristi Hamrick wrote after Planned Parenthood and South Carolina’s arguments to the U.S. Supreme Court Justices this spring, the arguments broke down as follows:
“Planned Parenthood to SCOTUS: If there’s money on the table, we get paid because we are ‘qualified’ to do a few things. In setting up insurance, you created a ‘right’ to coverage, and by extension, our right to be part of the program. If you choose to help people, you can’t decide to cut us out.
South Carolina to Planned Parenthood: Our desire to help poor people doesn’t mean you get anything. A program like Medicaid is for poor people to have health insurance and not for you to get paid. Planned Parenthood is not the center of the healthcare universe, as our program is for others, not you. And you’re not ‘qualified,’ which is part of the problem. Saying we want to provide some benefits is not a ‘magic word’ that means you have a right to be in our program or that an individual has a right to take the money and shop for whatever they want. The words’ rights,’ ‘privilege,’ or ‘free choice’ are not in the statute itself. It’s just the words that the abortion lobby and their legal friends are using to try and cut themselves in, and we can cut you out.”

Taxpayers have been forced to be generous to the nation’s number one abortion vendor. According to Planned Parenthood’s 2023-24 annual report, they received a 13% pay increase—from $699.3 million in 2022-2023 to $792.2 million—despite seeing a less than 2% patient increase compared to the previous report.
· Taxpayers are more on the hook than ever to support them, now forced to cover 39% of their total budget, up from 34%.
· The number of lives ended by abortion at Planned Parenthood’s hands rose again: 402,200 – up from 392,715 in their last report – about a 2.4% increase over the previous year and a 7.5% increase over the last two years.
· Adoption referrals are stagnant, reported at 2,148, compared to 1,721 in the previous report.
· “Other services” hide accurate data on Planned Parenthood’s sterilizing hormone sales to minors.
