Louisiana’s War on Chemical Abortion Pills: State Holds FDA Accountable for Lack of Regulation

Attorney General Liz Murrill is filing a lawsuit against the U.S. Food & Drug Administration (FDA), further cementing the Pelican State’s bold stance against Chemical Abortion Pill trafficking within its borders. 

For months, Louisiana has led the charge on the issue of Chemical Abortion trafficking after it gained national attention when a Louisiana mother reportedly forced her underage daughter to take pills obtained from a New York abortionist—an act that led to severe complications, a 911 call, and an Emergency Room (ER) visit.  

According to the Louisiana Illuminator, the lawsuit, filed on October 6th, calls for an end to the distribution of Chemical Abortion Pills without an in-person doctor’s visit. To do this, Louisiana Attorney General Liz Murrill, who has described practitioners who provide abortion through the mail as “drug dealers… violating our laws,” sued the FDA for violating the Comstock Act by allowing medical professionals to ship these deadly drugs through the mail.  

In the abortion lobby’s pursuit of profit, especially in states with pro-life laws, it started targeting selling women and abusers Chemical Abortion Pills online without any in-person visit. This means no ultrasound, no health workup, no guarantee of a doctor being present, and no regulation of the drugs. The Chemical Abortion Pill Cartel, which sells these death pills online across state lines, works through telehealth appointments with these businesses. On websites such as these, women do not have to show any identification or proof of pregnancy, which dramatically expands the abortion business and allows sexual abusers to get away with their crimes.   

Rosalie Markezich was a victim of the FDA’s reckless disregard and lack of regulations. Markezich, a Louisiana woman, will be joining Attorney General Murrill as a plaintiff in this pivotal case. In October 2023, Markezich’s boyfriend obtained Mifepristone from a California abortion facility and coerced her into a chemical abortion. Murrill filed a warrant for Dr. Remy Coeytaux, the California abortionist, for breaking Louisiana’s law, as well as indicting Dr. Margaret Carpenter and a minor’s mother for breaking Louisiana’s 2022 chemical abortion law, stating that it is illegal to cause a chemical abortion intentionally. This pregnant minor’s mother, in West Baton Rouge, bought Chemical Abortion Pills from Carpenter, a New York abortionist.  

Abortion pundits purposefully turn a blind eye when it comes to the Comstock Act, but clearly, Louisiana and the Pro-Life Generation (PLG) didn’t forget it. The Comstock Act, prohibiting anything that could be intended for abortion from being shipped through the U.S. Mail, was enacted in 1873, way before Roe v. Wade’s tragic ruling, and is clearly being violated.  

In addition to fighting for the Comstock Act, a Louisiana state law last year requiring Mifepristone and Misoprostol to be Schedule IV controlled substances, causing doctors and facilities to create significantly stricter storage and dispensing requirements. These drugs end human Life every day, so keeping them controlled not only brings about a greater regulation of pills, but it gives gravity to the tragic nature of these pills: the deliberate ending of preborn children and harm to the mothers.  

 If Louisiana can pull this off, forcing the FDA to have new regulations for chemical abortion and not allowing it to cross state lines, it can set a precedent for the rest of the country to actually follow the Comstock Act as well, beginning the eradication of the Chemical Abortion Pill Cartel.
