GUEST POST: Pro-lifers in Congress are calling on the Food and Drug Administration (FDA) and the Department of Justice (DOJ) to reverse dangerous expansion of the Chemical Abortion Pill and enforce existing laws to protect women and preborn babies.
U.S. Senator Cindy Hyde-Smith (R-Miss.) and U.S. Congressman Bob Latta (R-Ohio) sent the letter to the FDA. 75 members of the House and Senate joined the letter. In January, the Biden Administration announced that it will allow the Chemical Abortion Pill to be sold without in-person consultation. This means that brick-and-mortar pharmacies, as well as mail-order pharmacies, can dispense life-ending Chemical Abortion Pills after a mother has had only a no-test, telemedicine visit.
This rule change promotes mail-order, do-it-yourself abortions with little to no oversight or accountability for the abortion industry. In their letter, the legislators call on the FDA head, pro-abortion Robert Califf, to reverse the dangerous and illegal change.
The legislators write:
We call on the FDA to remove mifepristone [Chemical Abortion Pill] from the market, or, at minimum, promptly restore and further strengthen the initial basic health and safety requirements for abortion drugs, and cease permitting the mailing and shipping of abortion drugs in violation of Federal criminal law.
It is not an exaggeration to state that the distribution of Chemical Abortion Pills by mail is criminal. In a separate letter to the DOJ, Senator James Lankford (R-OK) condemned the Biden Administration for ignoring Constitutional responsibility and endangering women and babies with the radical expansion of abortion by mail. Senator Lankford was joined in his letter by 50 members of the United States House and Senate.
On January 3, the DOJ issued a legal opinion falsely claiming that Chemical Abortion Pills can be mailed into states with pro-life protections banning abortion. This is a clear violation of existing law, and the letter calls on Attorney General Merrick Garland to correct the DOJ’s faulty guidance and enforce the law.
As the pro-life legislators note, “It is disappointing, yet not surprising, that the Biden administration’s DOJ has not only abdicated its Constitutional responsibility to enforce the law, but also has once again twisted the plain meaning of the law in an effort to promote the taking of unborn life.” As Students for Life of America President Kristan Hawkins noted at the time, “A weaponized Department of Justice is once again putting abortion industry interests first in attacking the rights of each of the 50 states to protect their citizens.”
Lankford’s letter further states, “The reckless distribution of abortion drugs by mail or other carriers to pregnant mothers who have not been examined in-person by a physician is not only dangerous and unsafe, it is criminal.” Mothers have died following a failed chemical abortion. Students for Life of America applauds the pro-life senators and representative who rightly objected to the pro-abortion power grab. The FDA and DOJ are clearly maneuvering to force abortion on the American people. The Biden Administration, at the bidding of Big Abortion, has thwarted the system of law and order by circumventing citizens and enforcing a pro-abortion federal policy. During the pandemic, abortion activists used a national crisis to relentlessly push for dangerous telemedicine abortion. Now, the abortion cartel wants to make permanent the death-by-mail regime.
Following the overturning of Roe v. Wade, pro-life Americans, for the first time in 50 years, have the opportunity to protect preborn babies in their state. The Biden Administration, best friend of Big Abortion, is undermining that right and trying to enforce a top-down pro-abortion regime of telemedicine abortion.
As the legislators note in their letters, these illegal maneuvers will lead to loss of preborn life and endanger mothers. This is unacceptable. Students for Life of America has also called attention to how the expansion of the Chemical Abortion Pill poses risks to water treatment and threatens our water supply. No matter how you look at it, the Biden Administration’s expansion of Chemical Abortion Pills is bad for women, bad for babies, and bad for America.
