In 2024, over 10,000 abortions took place at or after 21 weeks gestation, when babies are developed enough to feel pain and often survive with medical care. In states like Virginia, where abortion is legal in cases up to birth, those numbers are climbing.
Despite this, nearly all Democrat Senators voted against the Pain-Capable Unborn Child Protection Act in 2018 and 2020 which protects children in the womb after 20 weeks gestation.
Furthermore, in January 2025, Republicans in Congress voted to protect babies born alive after failed abortions by supporting the Born‑Alive Abortion Survivors Protection Act (H.R. 21). Only one Democrat—Rep. Henry Cuellar—joined them. This common-sense bill would require doctors to provide the same medical care to a baby born during a failed abortion as they would to any other premature newborn.

Virginia: Ground Zero for Late-Term Abortion Extremism
In Virginia, Democrats in the General Assembly passed the first stage of a constitutional amendment that would enshrine unlimited abortion access—including up to birth—into the state constitution. If passed again in 2026, it heads to voters in November. If approved, it could effectively ban legal protections for abortion survivors, cementing infanticide into state policy.
Virginia is on the brink of becoming the most extreme abortion state in America. The time to act is now. Students for Life has launched a full-scale campaign to confront extremist politicians and demand action—in Congress and in states like Virginia.
The Numbers Democrats Don’t Want You to See
- 1,038,100 abortions occurred in 2024 in states without total bans. (Guttmacher Institute, 2025)
- Roughly 10,381 abortions took place at or after 21 weeks—when babies can often survive with care.
- In Virginia, 100–225 late-term abortions happen annually—each a possible case where a baby might be born alive.
- Studies suggest 1,100+ babies could be born alive each year during failed abortions—but current law does not guarantee care.
The Truth About Late-Term Abortion
- At 21 weeks, a baby has fingers, toes, facial features, and a beating heart.
- By 24 weeks, over 70% of babies survive with proper care.
- Nash Keen, born at 21 weeks in Iowa City in 2024, is now thriving at age 1.
Every baby born alive deserves a fighting chance.
Infanticide in America: What the Media Won’t Say
- Babies are being born alive during failed abortions—and left to die.
- In Minnesota, Florida, and Texas, reports confirm babies born alive after botched abortions were denied care.
- In Kermit Gosnell’s Philadelphia clinic, seven infants were murdered after surviving abortion. He went to prison—but the policies that enabled him remain.
- Planned Parenthood’s own lobbyist admitted care for a born-alive baby should be left to "the woman, her family, and her physician."
This isn’t rare. It’s real—and it’s happening in our country.
Politicians Who Enable Infanticide
- Del. Kathy Tran (D‑VA) confirmed her bill would allow abortion "up to the point of dilation."
- Gov. Ralph Northam suggested that a baby born alive could be left to die if the family wished.
- In states like California and Michigan, Democratic-led ballot measures in 2022 established constitutional protections for abortion rights, including late-term abortions. Now Democratic politicians in Virginia are trying to take it further.
- 251 members of Congress voted against protecting born-alive infants in January 2025.
This is not a fringe view. This is a bipartisan, compassionate, and overwhelmingly supported idea: Born alive means worth saving.
