In 2024, over 10,000 abortions took place at or after 21 weeks gestation, when babies are developed enough to feel pain and often survive with medical care. In states like Virginia, where abortion is legal in cases up to birth, those numbers are climbing.

Despite this, nearly all Democrat Senators voted against the Pain-Capable Unborn Child Protection Act in 2018 and 2020 which protects children in the womb after 20 weeks gestation.

Furthermore, in January 2025, Republicans in Congress voted to protect babies born alive after failed abortions by supporting the Born‑Alive Abortion Survivors Protection Act (H.R. 21). Only one Democrat—Rep. Henry Cuellar—joined them. This common-sense bill would require doctors to provide the same medical care to a baby born during a failed abortion as they would to any other premature newborn.

Virginia: Ground Zero for Late-Term Abortion Extremism

In Virginia, Democrats in the General Assembly passed the first stage of a constitutional amendment that would enshrine unlimited abortion access—including up to birth—into the state constitution. If passed again in 2026, it heads to voters in November. If approved, it could effectively ban legal protections for abortion survivors, cementing infanticide into state policy.

Virginia is on the brink of becoming the most extreme abortion state in America. The time to act is now. Students for Life has launched a full-scale campaign to confront extremist politicians and demand action—in Congress and in states like Virginia.

  • 251 members of Congress voted against protecting born-alive infants in January 2025.
